As per section 12(6) of the FC(R) Act, 2010, the FCRA registration shall be valid for a period of 5 years. However, the Ministry of Home Affairs (MHA) vide its circular dated 24th March, 2022, has extended the validity of such Certificates. The contents of the circular are mentioned below:
i) The validity of the FCRA registration shall be extended till 30th June, 2022 or till the date of disposal of the renewal application, whichever is earlier. This would apply only where the application for renewal has been filed and is pending till date.
ii) The validity of those FCRA Registration Certificates expiring during 1st April, 2022 to 30th June, 2022 and who have applied/ apply for renewal before expiry of 5 years validity is extended up to 30th June, 2022.
iii) In case of refusal of the application for renewal of FCRA registration certificate, the validity of the certificate shall be deemed to have expired on the date of refusal. Further such organization are not eligible to receive foreign contributions or utilize foreign contributions received earlier from the date of refusal.
